Press Note issued by Bahujan Samaj Party

Why Mr. P.L. Poonia, Chairman NCSC now keeping mum?

Hon'ble President of BSP Ms. Mayawati ji writes letter to Prime Minister to draw his attention towards sad plight of dalits of Mirchpur

Various national commissions behaving like political parties

by shunning their constitutional dignity

Lucknow: 14 June 2011 :: The Bahujan Samaj Party has strongly criticised severe beating of dalits of Mirchpur village (Haryana) who had demanded justice as they had been harassed by the stouts. The Hon'ble President of BSP Ms. Mayawati ji wrote a letter to the Prime Minister today in which she demanded that the Haryana Government should be directed to ensure justice for the victims of Mirchpur. She mentioned in her letter that various national commissions which were hyper active during petty incidents that took place in Uttar Pradesh, were unable to perform their duties well in this case.

The BSP Chief in her letter mentioned the incident that took place on 21 April 2010 in Mirchpur village in which the dalits were harassed severely and two persons of dalit community had died. Houses of dalits had also been put on fire.

Giving this information here today, the BSP Spokesman said that it was unfortunate that the Congress Government of Haryana instead of ensuring justice for the dalit victims was trying to suppress their voice by pressurising them through police. Taking serious note of the silence of the National Commission for Scheduled Caste (NCSC), he said that why Mr. P.L. Poonia who is himself a domicile of Haryana and presently Chairman of NCSC, was unable to see the injustice being handed out to the dalit victims of Mirchpur village.

The Spokesman said that the Hon'ble Court had ordered that the dalit victims of Mirchpur should be provided help. But, the Haryana Government failed to help them, then they went to the mini-secretariat of Hissar district to put their views before they administration. The victims, instead of being provided justice, were caned by Haryana police. The victims included women, old people and children.

The Spokesman said that the approach of the Chairman of the NCSC suggested that he was acting like an office bearer of a political party. He said that this was the reason why he was unable to see harassment of dalits in the Congress ruled state. He said that Mr. Poonia visited Uttar Pradesh at the smallest instance, while he did not go to Haryana even if the incident was of a greater magnitude. He demanded from the Chairman NCSC to visit Mirchpur village and ensure that the dalit victims were delivered justice; else he had no right to hold this post.

The Spokesman said that the National Commission for Women (NCW) should have taken the cognisance of the Haryana incident immediately and it should have taken tough measures at that time. Regretting the poor role of NCW in the Mirchpur incident, he said that the dalit victims were still waiting for justice. He said that the NCW had been levelling false allegations of misbehaviour with women during the Bhatta-Parsaul incident and tried to prove its faithfulness towards Congress party, but it had been keeping mum on the incident of misbehaviour with the women dalit victims of Mirchpur village.

The Party Spokesman said that the National Human Rights Commission visited U.P. in almost all the incidents, but it failed to visit Congress ruled states even if the incident was serious. Referring to the broad day-light killing of a senior journalist in Mumbai, the Spokesman said that the journalists were not satisfied the way Congress Government of Maharashtra had been handling the investigation. But, the NHRC was keeping silent.

The BSP Spokesman said that the various national commissions show their keen interest even in the smallest incidents that took place in Uttar Pradesh, while they kept silent on serious incidents that occurred in Congress ruled states, which indicated that they had been acting like political parties.

The Spokesman said that the Union Woman and Child Development Minister Mrs. Krishna Tirath, who had expressed her desire to meet Union Home Minister regarding a criminal incident of the State even though the BSP Government had taken effective action, kept silent on the Mirchpur incident. Mrs. Tirath should also tell the people whether she had taken notice of the rapes that took place in Delhi. He said that the police of the Congress ruled Delhi state was under the Union Home Minister. Therefore, Mrs. Tirath should meet the Union Home Minister in this regard so that such incidents which occurred in Delhi could be checked and the Delhi police were also given necessary directives. He said that the women of Delhi were feeling very insecure.

The Spokesman said that the data suggested that the rate of rape in Congress ruled Delhi was 2.6 per cent, in Haryana 2.5 per cent and Rajasthan 2.3 per cent while the national average was 1.8 per cent. The rate per cent of rape in U.P. was 0.9 per cent which was less than the national average. He said that in Delhi, 1975 crimes took place against women during 2009, while 2201 crimes occurred against women during 2010. Referring to the rape of a woman working in BPO which occurred on 24 November 2010 and another rape incident that occurred in Sultanpuri area of Delhi, the Spokesman pointed out that these incidents took place in the capital of the country. But, the Union Woman and Child Development Minister did not show any sensitivity in this regard, nor the Delhi Government was put in the dock. The Central Government was also spared.

The Spokesman said that the BSP was vehemently demanding protection of the dalits of Mirchpur village, but the Congress Government of Haryana had not made any serious arrangement of their protection. He pointed out that this was the reason that the victims of Mirchpur were still living with fear. He said that those who were issuing statements in the media daily should go to Mirchpur which is just 150 km. away from the national capital and ensure that they got justice.

Press Note issued by Bahujan Samaj Party State Office, Lucknow

Opposition's insistence on rape of Nighasan victim,

injustice towards victim and her family

as both post-mortem reports did not suggest rape

CB-CID earlier solved several cases impartially,

Sheelu case of Banda was investigated by CB-CID recently

State Government has already taken stringent action to punish culprits, Government committed to punish guilty

Lucknow: 14 June 2011 :: The Spokesman of Bahujan Samaj Party has termed the allegation of rape of the Nighasan victim levelled by senior leaders of opposition parties as unfortunate and baseless. He pointed out that the State Government had already taken punitive action in this case and was committed to take severe punishment against the guilty. The Party Spokesman said that as soon as the Hon'ble Chief Minister ji came to know about the incident, she directed the senior officers to investigate the case thoroughly and take severe action against the guilty. He said that in consonance with the orders of the Hon'ble Chief Minister ji second autopsy was conducted of the victim by sending a team from Lucknow HQ. It had one woman member as well.

The Spokesman said that the second autopsy confirmed that the victim was murdered and it was not a case of suicide. The rape was not confirmed, he added. Yet, the senior leader of Congress Mr. Digvijay Singh, who was himself Chief Minister of Madhya Pradesh twice and Mr. Azam Khan who himself was a senior minister in S.P. Government, had been repeatedly alleging rape of the victim which was irresponsible behaviour on their part. He said that these opposition leaders should have confirmed facts before making any statement. He said that it was clear that they were trying to take political mileage of the issue.

The BSP Spokesman said that one inspector and two constables had been arrested for destroying evidence and had been sent to jail after registering case against them. All the three doctors, who had submitted false report of the first autopsy, have already been suspended and action had also been initiated against them. The SP Lakhimpur-Kheri had also been transferred. The incident was being investigated by CB-CID and its report would be submitted at the earliest.

The Party Spokesman pointed out that the decision of the State Government to get this case investigated by CB-CID and its integrity should not be questioned. He said that the Sheelu case of Banda had been solved by the same agency and it had proven wrong the allegations of the opposition parties at that time.

The Spokesman said that the truth is that the tough measures taken by the Hon'ble Chief Minister ji in this case and the transparent way of investigation and punitive action taken against the guilty had unnerved the opposition parties. Now, they were trying to create confusion among the people. The Spokesman reminded that the Hon'ble Chief Minister ji had given explicit orders to the senior officers to ensure that nobody violated law no matter whosoever he was.

The BSP Spokesman suggested that the opposition leaders should wait patiently and let the State Government's action complete. He said that in next few days all facts would be cleared. He assured that the culprits would not be spared.
